Under instructions from my client, Dr.S.P.Udayakumar, 27, Isanganvilai, Mani Veedhi, Parakkai Road Junction, Nagerkovil 629002, I address you as under:
My client was shocked to see a news item published in the Hindu (City Edition : Chennai) dated 6 February 2012. The caption of the news item at page 6 of The Hindu reads “Bishop’s NGOs received Rs.54 cr.” Paragraphs 2 and 3 of the news item read as follows:
“These two NGOs are being administered by RC Bishop of Tuticorin Diocese Rt. Rev. Yvon Ambroise,” the Union Minister of State in the Prime Minister's Office told reporters after a public meeting organised here on Saturday evening, demanding immediate commissioning of the nuclear power project.
He said that while the Bishop's two NGOs had received Rs. 54 crore, another NGO being run by anti-KKNPP struggle committee convener S.P. Udayakumar received foreign funds to the tune of Rs. 1.50 crore.”
My client states that you have made a totally false allegation against my client to the effect that an NGO run by my client received foreign funds to the tune of Rs.1.50 crore. You have not even given the name of the NGO which is said to have received foreign funds. You have made this false allegation against my client with an intention to harm the reputation of my client. The said false allegation of yours is an imputation which directly, in the estimation of the members of the public, lowers the moral character of my client and also lowers the credit of my client. Your imputation about my client is an utter falsehood. By making such imputation, you have not only harmed my client’s reputation but have also acted contrary to public interest.
Kindly take notice that you have, by making a statement to the press that my client’s NGO received foreign funds to the tune of Rs.1.50 crores, defamed my client and committed an offence punishable under section 500 IPC.
Kindly take further notice that if you do not, within 3 days from the date of receipt of this notice, publish your apology in the front page of The Hindu (City Edition, Chennai), my client will be forced to initiate appropriate civil and criminal proceedings against you at your costs.
